Terms & Conditions 

By accessing or using the SEPT platform, email plugin, or mobile applications (collectively, the “Service”), you agree to be bound by these Terms & Conditions. Please read them carefully before using the Service. If you do not agree, do not use the Service. 

1. Ownership and Intellectual Property
   The Service, including all associated software, code, trademarks, logos, and other intellectual property rights, remains the exclusive property of SEPT SOFTWARE Inc. You may not:

• Copy, modify, reverse-engineer, or create derivative works of the Service; 

• Attempt to extract or access the Service’s source code; 

• Use SEPT’s trademarks without written permission. 

 

2. Scope of Service
   These Terms apply to:

• The SEPT web application (“Platform”) accessed via browser; 

• SEPT mobile applications for iOS and Android; 

• The SEPT Email Plugin for Microsoft Outlook and other supported clients; 

• Any APIs, integrations, or related services we provide. 

We may modify, add, or remove features at any time. We may also offer paid features or subscriptions and will clearly disclose associated costs before you are charged. 

 

3. Account Responsibilities
   You are responsible for:

• Keeping your account credentials secure; 

• Ensuring no one else uses your account without permission; 

• Complying with all applicable laws when using the Service; 

• Not sharing, selling, or otherwise transferring your account access. 

 

4. Acceptable Use
   You agree not to use the Service to:

• Send spam, phishing, or unsolicited messages; 

• Harass, defraud, or harm others; 

• Infringe the intellectual property rights of others; 

• Bypass usage limits, security features, or authentication measures; 

• Upload or transmit malicious software or code. 

We may suspend or terminate your account if you violate these rules. 

 

5. Data Privacy & Processing
   We store and process personal data you provide to deliver the Service. This may include:

• Email metadata, body content, and attachments (when you authorize the Email Plugin); 

• Project, contact, and file data entered into the Platform; 

• Account details such as your name, email, and organization information. 

By using the Service, you consent to our data collection and handling practices as described in our Privacy Policy. You are responsible for ensuring that any data you share with us complies with applicable privacy laws (e.g., GDPR, CCPA, PIPEDA). 

 

6. Third-Party Services
   The Service integrates with third-party providers whose own terms apply:

• Amazon Web Services 

• Microsoft Azure 

• Microsoft Graph & Outlook API 

We are not responsible for downtime, changes, or failures caused by these services. 

 

7. Service Availability
   Some features require an active internet connection. We are not responsible for:

• Service interruptions due to connectivity issues; 

• Delays or failures in sending or receiving emails; 

• Data loss caused by third-party outages or your device running out of storage or battery. 

If you access the Service via a mobile network, your carrier’s data charges may apply, including roaming charges. 

 

8. Updates and Discontinuation
   We may release updates to maintain or improve the Service. You agree to install updates promptly.
   We may discontinue the Service or specific features at any time. If we do, we may provide notice and, where possible, give you a reasonable opportunity to export your data.  
9. Termination
   We may suspend or terminate your access if you violate these Terms or applicable laws. Upon termination:

• Your right to use the Service will end immediately; 

• You must stop using and uninstall the Email Plugin; 
• We may retain or delete your data in accordance with our Privacy Policy.

 

10. Limitation of Liability
    To the maximum extent permitted by law, SEPT SOFTWARE Inc will not be liable for:

• Loss of profits, revenue, or data; 

• Business interruption; 

• Indirect, incidental, or consequential damages; 

• Any reliance on information or results provided by the Service. 

 

11. Governing Law
    These Terms are governed by the laws of Alberta, Canada, without regard to conflict of laws principles. Any disputes will be resolved in the courts of Alberta.
12. Changes to These Terms
    We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on our website or within the Service.
